• Authenticity: You warrant that all coins you list are authentic and not counterfeit, altered, or misrepresented in any way. You agree to accept returns for any items found to be counterfeit or not as described.
• Anti-Fraud Policy: Any attempt to defraud buyers through false descriptions, counterfeit items, failure to ship purchased items, or other deceptive practices will result in immediate and permanent ban from the Site. We reserve the right to report fraudulent activity to appropriate authorities.
• Compliance: You agree to comply with all applicable laws and regulations regarding the sale and shipment of numismatic items.
• Dispute Resolution: You agree to work in good faith to resolve any disputes with buyers and to respond promptly to inquiries and concerns.
• Authorization to Advertise: You agree to allow Rare-Change.com to use your postings on 3rd party advertising networks and special arrangements.
• Taxes Are Your Responsibility: Sellers are responsible for reporting and paying sales tax in their jurisdiction. We do not collect sales tax on their behalf.

5. Terms for Buyers

As a buyer on Rare-Change.com, you acknowledge and agree to the following:

• Risk of Fraudulent Items: While we make our best efforts to prevent fraudulent listings and verify seller information, you acknowledge that there is an inherent risk when purchasing collectible coins online. You may receive items that are counterfeit, misrepresented, or not as described. If you discover such an issue without our return policy period, you agree to notify the seller promptly and work in good faith to resolve the issue.
• Due Diligence: You are responsible for conducting your own due diligence before purchasing, including reviewing seller ratings, asking questions, requesting additional photos, and having coins authenticated by professional services when appropriate.
• Authentication: We strongly recommend having high-value purchases authenticated by reputable third-party grading services (such as PCGS, NGC, or ANACS) upon receipt.
• Dispute Process: If you believe you have received a fraudulent or misrepresented item, you must notify the seller within 14 days of receipt and work in good faith to resolve the issue with the seller. You may simply ask for a refund, or if you cannot reach a resolution, you may contact our support team for assistance.
• Payment: You agree to pay for items you purchase and complete transactions in a timely manner according to the seller's terms.
• Returns / Exchanges: You have the right to return items due to issues with authenticity within 14 days of receiving the item. Buyers must work directly with sellers to resolve any issues regarding returns. Sellers are obligated to accept returns. Rare-Change.com may assist in dispute resolution if necessary.

6. Limitation of Liability and Indemnification

Marketplace Role: Rare-Change.com operates as a marketplace platform that connects buyers and sellers. We are not a party to transactions between users and do not take possession of, verify, or authenticate items listed on the Site.

No Warranties: THE SITE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, RARE-CHANGE.COM, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO:

• Fraudulent transactions or seller misconduct
• Counterfeit, altered, or misrepresented items
• Disputes between buyers and sellers
• Financial losses from purchases or sales
• Unauthorized access to your account
• Errors, omissions, or inaccuracies in listings
• Loss of data or business interruption

Indemnification: You agree to indemnify, defend, and hold harmless Rare-Change.com, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use of the Site
• Your violation of these Terms of Service
• Your violation of any rights of another party
• Your listings, sales, purchases, or transactions on the Site
• Any fraudulent or illegal activity in which you engage

7. Account Termination and Suspension

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Fraudulent activity or attempted fraud
• Repeated complaints from other users
• Listing counterfeit or illegal items
• Abusive or harassing behavior toward other users

Termination of your account does not relieve you of obligations incurred prior to termination.

8. Intellectual Property

The Site and its original content, features, and functionality are owned by Rare-Change.com and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
